1. Acceptance of Terms
By creating an account on or accessing Outinery ("the Service", "we", "us", or "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Service.
These Terms constitute a legally binding agreement between you and Outinery. We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
2. Eligibility
You must be at least 16 years old to use the Service. This age requirement is in compliance with the UK Data Protection Act 2018 and the EU General Data Protection Regulation (GDPR) Article 8.
By creating an account, you confirm that you meet this age requirement. We collect your date of birth during account setup to verify eligibility. If we discover that a user is under 16, we will immediately suspend their account and delete their personal data.
3. Account Registration and Security
You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
You may register via email and password or through a third-party authentication provider (such as Google). We do not store your third-party passwords.
You must notify us immediately at support@outinery.com if you believe your account has been compromised.
4. Service Description
Outinery generates personalised itineraries and day-out plans using a combination of artificial intelligence, curated venue databases, and third-party services. The Service is provided "as is" and recommendations are for informational purposes only.
4.1 Automated Decision-Making
The Service uses automated systems, including large language models (OpenAI GPT) and vector similarity search (Pinecone), to generate itinerary recommendations. These systems process your location, vibe preferences, and prompt text to produce personalised results.
Under GDPR Article 22, you have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. Our itinerary recommendations are suggestions only — they do not have legal effect and you are free to disregard them. You can adjust your preferences at any time in your profile settings.
4.2 Third-Party Venues and Services
Venues, events, and activities shown in itineraries are sourced from third-party data providers. We do not own, operate, or endorse these venues. Opening hours, prices, availability, and quality may differ from what is displayed. Always verify details directly with the venue before visiting.
5. Subscriptions and Billing
Some features of the Service may require a paid subscription or credit purchase. Prices, billing cycles, and included features are displayed on the subscription page before purchase.
- Free tier: Limited itinerary generations and swaps per month at no cost.
- Paid subscriptions: Billed monthly or annually as displayed at checkout. You may cancel at any time — access continues until the end of your current billing period.
- Credit packs: One-time purchases that do not auto-renew. Credits do not expire.
Payments are processed by our third-party payment provider. We do not store your full payment card details.
6. User Conduct
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access, tamper with, or disrupt our systems.
- Scrape, reproduce, or redistribute Service content without permission.
- Impersonate another person or misrepresent your identity.
- Submit prompts designed to generate harmful, illegal, or abusive content.
- Circumvent rate limits or entitlement restrictions.
7. Intellectual Property
All content, technology, trademarks, and design elements provided by Outinery are our property or licensed to us and are protected by intellectual property law. You may not copy, modify, or redistribute them without written permission.
Itineraries generated for you are for your personal, non-commercial use. You may share them with friends and travel companions.
8. Limitation of Liability
To the fullest extent permitted by law, Outinery and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: costs incurred at recommended venues, travel delays, personal injury, property damage, or loss of data.
Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by English law.
9. Account Termination
You may delete your account at any time from your profile settings. Upon deletion, all your personal data will be permanently erased in accordance with our Privacy Policy.
We reserve the right to suspend or terminate accounts that violate these Terms, abuse the Service, or are determined to belong to users under the minimum age.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer in the European Union, you retain any mandatory consumer protection rights under the law of your country of residence that cannot be waived by agreement.
